1 Parties and Scope

These Terms of Service govern the legal relationship between İsmail Dursun ("Platform Owner", "we", "us"), the individual operator of the digital platform surfinginturkey.org(surfinginturkey.org, and any natural person ("User", "you") who accesses or registers on the platform.

These Terms apply to all pages, mobile interface, API access, and services offered through the platform. Continued use of the platform constitutes acceptance of these Terms.

2 Service Description

The platform is a meteorological information service that provides real-time and historical wind data (speed, gust, direction) collected from wind measurement stations. Key features include:

• Real-time wind map and station data
• Historical wind charts (Wind Archive)
• Free and paid membership tiers
• Multilingual interface (Turkish / English)

3 Membership and Account

To register on the platform, you must:

• Be at least 18 years of age, or have parental/guardian consent
• Provide a valid and active email address
• Submit accurate and current information on the registration form
• Complete the email verification process

Each user may hold only one account. Creating accounts on behalf of others is prohibited. You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

If you become aware of any unauthorized use of your account, you must immediately notify us at [email protected].

4 Paid Membership and Payment

The platform offers both free and paid (Premium/Pro) membership options. The following conditions apply to paid subscriptions:

• Subscription fees are charged at the price displayed at the time of purchase.
• Payments are processed securely through an integrated payment provider. Card details are not stored on our servers; they are managed exclusively by the payment provider.
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• Cancellation requests must be submitted at least 24 hours before the renewal date via account settings or by emailing [email protected].
• As the service constitutes digital content, refund eligibility after service delivery begins is evaluated on a case-by-case basis in accordance with applicable consumer law.

5 Acceptable Use

The following actions are strictly prohibited:

• Attempting to compromise or attack the platform or its infrastructure
• Attempting to access other users' accounts without authorisation
• Registering with false, misleading, or third-party identity information
• Reselling or redistributing platform data to third parties for commercial gain
• Uploading or injecting malicious code or content that disrupts platform operation

Violation of these rules may result in immediate account suspension or termination without prior warning.

6 Intellectual Property

The platform's design, source code, graphics, software, and content are the exclusive property of İsmail Dursun and are protected under applicable intellectual property laws.

Users are granted a limited, non-transferable, revocable licence to access the platform solely for personal, non-commercial purposes. Under this licence:

• Copying, modifying, or distributing platform content is prohibited.
• Brief quotations with proper attribution are permitted for research and educational use.

7 Limitation of Liability

Platform data may be delayed, incomplete, or inaccurate due to technical faults, connectivity issues, or device errors.

The Platform Owner shall not be held liable for any indirect, incidental, or consequential damages arising from the use of the platform, including but not limited to accidents, financial loss, or missed opportunities.

8 Service Interruption and Modification

The Platform Owner reserves the right to temporarily suspend or modify the service for maintenance, updates, or technical reasons.

Scheduled maintenance will be announced in advance where possible; however, emergency downtime may occur without prior notice. No compensation is owed for service interruptions.

9 Account Suspension and Termination

Your account may be suspended or permanently deleted without prior notice in the following circumstances:

• Violation of the Acceptable Use policy (Section 5)
• Use of false identity or fraudulent payment information
• Attempted attack on the platform
• Extended inactivity (12+ months) — prior email notification will be sent

To voluntarily close your account, please use the account settings or send a request to [email protected]. Personal data will be deleted in accordance with the timeframes specified in our Privacy Policy.

10 Changes to Terms

These Terms may be updated from time to time. Material changes will be communicated to your registered email address at least 7 days before taking effect and announced on the platform homepage.

Continued use of the platform after a change notification constitutes acceptance of the updated Terms.

11 Governing Law and Disputes

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from the interpretation or application of these Terms shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Fethiye, Turkey.

The parties agree to first attempt to resolve any dispute through good-faith negotiation via [email protected] before initiating formal legal proceedings.
